Good point, Leslie. I get a quarterly report from ASCAP itemizing all royalties from various sources (basically a nicely formatted blank page) :) and there isn't a line item for online downloads. I know radio stations have to submit a playlist to ASCAP, but I don't know that YouTube-like sites are being regulated like that. so I doubt that when I use my own music in a machinima that it will generate performance royalties per play, or at all.

You've got me thinking that maybe there is a source of revenue a songwriter can go after in my blog entry's scenario: YouTube! I may be distributing the cover tune I performed for free, but YouTube is getting banner ad revenue with every click-through and page impression, so that might be an interesting wrinkle.

Good question! Would recording royalties on an MP3 only apply if the MP3 is downloaded, whether as a freebie or paid - or distributed on CD/tape?

I wonder if ASCAP/BMI/SESAC are going after youtube (and the other similar Web 2 video sites) for performance/airplay royalties, since your single copy of the song, as sound track for video, is being heard by anyone running your clip - so it's basically like a TV station in that sense. Not that you, as backporch songwriter, would ever actually *see* a performance royalty check from ASCAP...

If you do find out, let me know. I'd also DEARLY love to know the status on this.

(If I'd been more certain, there would have been a hell of a lot of cover versions on BloodSpell.)
